New Delhi: The Immigration and Foreigners Bill, 2025 is set to introduce strict measures against illegal immigrants, including imprisonment and fines. Individuals entering India without a valid passport or visa could face up to five years in prison and fines of up to ₹5 lakh. The bill, which proposes stringent penalties for illegal immigration, is expected to be tabled in the Lok Sabha during this parliamentary session.
The new bill aims to replace existing laws, including the Foreigners Act, 1946, Passport Act, 1920, Registration of Foreigners Act, 1939, and Immigration Act, 2000. Under the proposed legislation, those residing in the country with forged documents could face imprisonment of two to seven years, with fines ranging from ₹1 lakh to ₹10 lakh. Currently, anyone entering the country with a fake passport faces up to eight years in prison and a ₹50,000 fine.
Additionally, higher education institutions and universities will be required to share information about foreign students with the registration office. Those overstaying their visa, violating immigration guidelines, or entering restricted areas could face up to three years in prison, a ₹3 lakh fine, or both.
The bill also introduces penalties for aiding foreigners without proper travel documents. Individuals found assisting illegal immigrants in their travel could be fined up to ₹5 lakh. If fines remain unpaid, authorities will have the power to seize vehicles, including planes and ships, used by foreign nationals.
